Terms of Use & Evaluation

These terms govern your access to and use of ForeProof's websites, the ForeProof STORM preview, and any related materials (the "Service"). ForeProof is a 6th Wave Ventures product, operated by 6th Wave Ventures. By requesting access or using the Service, you agree to these terms.

1. Evaluation access

Access is offered to utilities and research partners for the sole purpose of evaluating the Service. Access is granted at our discretion, is personal to you, and may be limited, suspended, or revoked at any time.

2. Confidentiality & no copying

The Service and all data, models, methods, screens, designs, and outputs you access are confidential and proprietary. You agree not to: reproduce or redistribute them; reverse-engineer, decompile, or derive their methods; benchmark them for publication; recreate their design or functionality; or disclose your access to third parties. These obligations survive termination of access.

3. Intellectual property

All intellectual property in the Service is and remains owned by ForeProof. No license is granted except the limited, revocable right to use the Service for evaluation as described above.

4. Simulation only — not an operational forecast

The Service is a simulation and decision-research platform. It is not connected to live SCADA, is not an operational or real-time forecast, and must not be relied upon for operational, dispatch, emergency, or life-safety decisions. All figures are modeled estimates for planning and research and are labeled as real, estimated, or simulated.

5. No warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, or non-infringement.

6. Limitation of liability

To the maximum extent permitted by law, ForeProof will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from reliance on the Service.

7. Suspension & termination

We may suspend or terminate your access at any time, including for breach of these terms. Upon termination you must cease using the Service and destroy any materials in your possession.

8. Governing law

These terms are governed by the laws of [jurisdiction], without regard to conflict-of-laws rules.
